Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Storynote website, beta waitlist, and the Storynote iOS application (including TestFlight builds) (collectively, the "Service"). Storynote, LLC ("Storynote", "we", "us") provides the Service subject to these Terms.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Eligibility & Accounts
You must be at least 18 years old to use Storynote. By using the Service, you represent that you meet this requirement and that any information you provide to us is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Beta Access & TestFlight
Storynote is currently offered as a beta product and may be made available through Apple TestFlight or other pre-release channels. As a beta user, you understand and agree that:
- The Service may change frequently and may contain bugs or incomplete features.
- The Service may experience interruptions, downtime, or data loss.
- We may limit, suspend, or terminate your access to the beta or specific features at any time, with or without notice.
3. Use of the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for personal, non-commercial purposes.
You agree that you will not:
- Use the Service for any unlawful or harmful purpose.
- Upload or share content that is illegal, infringing, hateful, harassing, abusive, or otherwise objectionable.
- Attempt to gain unauthorized access to the Service or any related systems or networks.
- Reverse engineer, decompile, or disassemble any portion of the Service except as allowed by applicable law.
4. User-Generated Content
Storynote allows you and other users to create stories, upload photos and notes, and interact through comments and reactions ("User Content"). You retain ownership of your User Content.
By submitting User Content to the Service, you grant Storynote a worldwide, non-exclusive, royalty-free license to store, process, display, and otherwise use your User Content as necessary to operate and improve the Service, including providing collaborative stories to you and other authorized participants.
You are solely responsible for your User Content and for ensuring that you have all necessary rights to upload and share it. You agree that your User Content will not violate any law or the rights of any third party.
5. Intellectual Property
Storynote and its logos, designs, text, graphics, software, and other materials ("Storynote Content") are owned by or licensed to Storynote, LLC and are protected by intellectual property laws.
Except as explicitly allowed by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Storynote Content, nor may you reverse engineer or attempt to extract the source code of any software used in the Service.
6. Third-Party Services
The Service may integrate with or rely on third-party services such as Firebase, Google Analytics, or email delivery providers. Your use of those services may also be governed by separate terms and privacy policies of those third parties.
7. Email Communications & Waitlist
When you join the beta waitlist or create an account, you consent to receiving emails from us related to the beta, onboarding, product updates, and important service notices. You can opt out of non-essential communications at any time by using unsubscribe links or contacting us.
8. Account Deletion
You may delete your Storynote account directly within the iOS app by navigating to Settings → Delete account & data. When you submit a deletion request, your account will be scheduled for permanent removal.
After submitting a deletion request, your account will remain in a recoverable state for up to 30 days. During this period you may cancel the deletion request and restore access to your account. After the retention window expires, your account and associated personal data will be permanently deleted from our systems.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STORYNOTE, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless Storynote, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or your violation of these Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date at the top of this page. If the changes are significant, we may provide additional notice, such as by email or in-app messages.
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service will immediately cease.
